A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §21-1-3a, relating to
requiring persons engaged in natural gas horizontal well
drilling activities to annually submit a report to the
Department of Labor identifying the state of residency of the
individuals who perform the well drilling work.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §21-1-3a, to read as
follows:
ARTICLE 1. DIVISION OF LABOR.
§21-1-3a. Duties of employers and owners conducting horizontal
well drilling activities.
__________Every employer or owner, including contractors and
subcontractors of an employer and owner, who conducts any
horizontal drilling of a natural gas well or converts any existing well, vent hole or other hole to a horizontal well, including any
site preparation work which involves any disturbance of land, shall
furnish to the Department of Labor information identifying the
residency of all persons employed in any capacity in those drilling
activities. For the purpose of this section, a person's residence
is the state in which he or she files a state income tax return.
The information is required to be submitted to the department no
later than January 31 of each year, beginning in the year 2014, for
all persons employed, full and part-time, in any capacity in the
horizontal drilling activities set forth in this section during the
preceding year. In the event a person files more than one state
income tax return, that information is also to be submitted.
NOTE: The purpose of this bill is to require persons engaged
in natural gas horizontal well drilling activities to annually
submit a report to the Department of Labor identifying the state of
residency of the individuals who perform the well drilling work.
This section is new; therefore, it has been completely
underscored.
